China Seismological Network officially measured: At 02: 09 on January 23rd, an earthquake of magnitude 7.1 occurred in Wushi County, Aksu Prefecture, Xinjiang (41.26 degrees north latitude and 78.63 degrees east longitude) with a focal depth of 22 kilometers.

The average elevation within 5 kilometers of the epicenter is about 3048 meters. The epicentre is 41km away from Aheqi County, 50km away from Wushi County, 135km away from Aksu City and 790km away from Urumqi City. According to the catalogue of China Seismic Network Express, there have been 166 earthquakes of magnitude 3 or above within 200 kilometers around the epicenter in recent five years, and the largest earthquake is this one.

The earthquake caused a strong sense of earthquake in the surrounding areas, such as Aksu, Artux, Kashgar, Yili, Korla and Karamay, and there were reports of earthquakes in Urumqi. The villages within 20km around this earthquake are Baishi Alsac, Honggou, Taikeqibeixi, Sesketkenengbeixi, Bailer and Balemaza, and there are no townships within 20km, while the townships within 50km are Yamansu Kirgiz and Aotebeixi. After the strong earthquake, aftershocks of magnitude 4.5, 5.2 and 4.6 occurred near Wushi County at 2: 14, 2: 42 and 2: 50. After the earthquake, the fire rescue detachment in Aksu dispatched 2 cars and 10 people from the earthquake rescue advance team of Wushi County Fire Rescue Brigade to gather and dispatch to the epicenter area for exploration. A light team of Aksu fire rescue detachment, with 13 vehicles and 60 people, has rushed to the epicenter.

Xinjiang Fire and Rescue Corps immediately launched the first-level response mechanism for earthquake disasters. A 1-year-old baby girl was paralyzed after thallium poisoning, and her father was poisoned before! The poisoner was a big aunt and was sentenced to death in the first instance.

In the Spring Festival of 2022, a 1-year-old baby girl named Amathallium in Fujian was poisoned. The police found out that it was poisoned by her aunt Wang Xia’s milk powder, and her father Lin Jianwei’s death more than half a year ago was identified as colchicine poisoning.

Today, Amao is quadriplegic, has many sequelae and is often hospitalized.

In September 2023, Fuzhou Intermediate People’s Court sentenced Wang Xia to death for intentional homicide. Red Star News learned that the Fujian High Court, the second instance of this case, opened in April 2024 and has not yet pronounced a verdict.

The Lins and Amao’s mother Yang Zao didn’t forgive Wang Xia. At first, the family couldn’t believe that Wang Xia had poisoned it, and they couldn’t understand it.

The Lins opened a shop in Fuzhou, and the conditions at home were good. The first-instance judgment obtained by Red Star News shows that the court found that Wang Xia poisoned because he was dissatisfied with the store in his home and distributed it to his brother-in-law.

Online shopping thallium nitrate poisoning

The baby girl who just turned 1 year old was poisoned after eating milk powder.

According to the judgment of the first instance, Wang Xia has searched for information about thallium nitrate, colchicine and other poisons many times, and also searched for online information such as "My husband and children are dead, can I inherit the property of my in-laws?"

According to public information, thallium is a slow-onset toxic substance with hidden symptoms. Thallium is colorless and tasteless after being dissolved in water, and it is not easy to detect after being drunk by people.

According to the judgment of the first instance, in November 2021, Wang Xia spent 465 yuan to buy 3 grams of colchicine online from a trading company in Xi ‘an. Wang Xia confessed that when she bought it, she tried it too hard and dumped it, and then she bought thallium nitrate. At the same time, she said that she had previously brushed a case of someone poisoning with thallium on the video website, and she had the idea of poisoning the algae with thallium. In January 2022, Wang Xia bought 25 grams of thallium nitrate from the above-mentioned company through WeChat for 1700 yuan.

The judgment of the first instance shows that at the end of January 2022, Wang Xia returned to his hometown for the New Year with his husband’s family. Wang Xia confessed that she didn’t have a chance to poison her just a few days before she returned to the village. Later, she learned that her mother-in-law was going to give Amao a one-year-old banquet. She was very angry and had the idea of throwing thallium nitrate to Amao.

On February 4, 2022, just after Amao’s first birthday, at noon that day, Wang Xia threw thallium nitrate into Amao’s milk powder jar while others went out to eat at home. On the same day, Amao suffered from diarrhea and fever after eating milk powder, and was sent to the clinic for treatment, and then transferred to Fuzhou Children’s Hospital for treatment.

Thallium was detected in Amao blood, Yang Zao blood, milk bottle, milk powder and Wang Xia’s toilet.

Amao was in a coma for a while, and he was diagnosed in PICU for a week. On February 22, 2022, a young man in the Lins’ family sent Weibo to ask for medicine online. "Prussian blue, the antidote to thallium, is rare." The young man told Red Star News that he contacted a hospital in Beijing with the help of the Internet and took 10 bottles of medicine.

Huang Yue, the grandmother of the child, said that she had never thought that her little granddaughter and younger son were poisoned. After the hospital found thallium poisoning, it told them or artificially poisoned them, but they didn’t believe it. Finally, the hospital called the police.

In the early morning of February 28th of the same year, Wang Xia was arrested at his residence. The verdict shows that Wang Xia denied poisoning at the beginning of the day, and then confessed to poisoning Amao.

Lin Jianxiong, the child’s uncle, said that he was arrested together and was later released from suspicion.

Brother in law died "accidentally"

He was identified as poisoned and died of multiple organ failure.

After Wang Xia was arrested, he confessed to poisoning brother in law, and the "accidental" death of Amao’s father Lin Jianwei was brought out more than half a year ago.

According to the judgment of the first instance, on March 10, 2021, Wang Xia spent 775 yuan online to buy 5 grams of colchicine from the above trading company through WeChat. On March 18th, Wang Xia secretly pinched a pinch of colchicine at the store and put it in Lin Jianwei’s rice bowl. After eating it, Lin Jianwei felt bitter and spit it out, thinking that the bought clam was not fresh. Lin Jianwei suffered from severe diarrhea that night and went to the clinic.

At the beginning of June of that year, Lin Jianwei suffered from gastrointestinal discomfort again. On June 25th, Lin Jianwei drank beer and ate two crayfish at home in the evening. He went to the hospital for diarrhea and vomiting the next day and was treated as appendicitis. On June 27th, he was transferred to the First Affiliated Hospital of Fujian Medical University. Only two days later, Lin Jianwei died after being rescued, and the body was cremated the next day.

At that time, the Lin family thought it was an emergency, and they didn’t do autopsy, but the doctor took Lin Jianwei’s blood sample and sent it to Shenzhen for pathogenic microorganism examination. Keep the blood sample as the key evidence afterwards.

The judgment of the first instance shows that in March 2022, thallium was not detected in the ashes of Lin Jianwei, and the colchicine content in blood isolates (plasma) and (blood cells) in its retained blood samples exceeded the lethal blood concentration.

An expert review opinion from a judicial expertise center showed that Lin Jianwei was eligible to die of multiple organ failure caused by colchicine poisoning. According to the materials submitted for inspection, the possibility of poisoning again before his death is not ruled out.

In April 2023, Fuzhou People’s Procuratorate filed a public prosecution against Wang Xia, and Amao and Yang Zao filed an incidental civil lawsuit. In May 2023, Fuzhou Intermediate People’s Court heard the case in the first instance.

One of the focuses of the trial was whether Wang Xia poisoned Lin Jianwei to death for the second time, and Wang Xia did not admit the second poisoning.

According to the judgment of the first instance, Wang Xia’s defender suggested that there was no evidence that Wang Xia put colchicine again after March 2021, which was a crime suspension. In addition, although colchicine was found in blood samples, Lin Jianwei’s body was not dissected and the cause of death was unknown; The expert review opinion is not an expert conclusion and cannot be used as evidence.

In this regard, the court of first instance held that the opinions of experts can be accepted as inspection reports. Although Wang Xia didn’t confess to poisoning Lin Jianwei again, other evidences confirmed each other to form a chain of evidence to prove his poisoning again, which was enough to confirm that Lin Jianwei’s death was caused by Wang Xia’s poisoning. There are no other possible death cases found in the existing evidence, so it should be recognized that there is a causal relationship between Wang Xia’s poisoning behavior and Lin Jianwei’s death result in criminal law.

Defenders have suggested that Lin Jianwei had drunk beer and taken cephalosporins before his death, and the improper use of drugs could not be ruled out. The court held that poisoning itself was enough to kill, even if the above-mentioned behavior had an impact on the death result, it was too small to block the causal relationship between Wang Xia’s poisoning behavior and the victim’s death result.

Regarding poisoning Amao, Wang Xia argued that after accidentally shaking all the thallium nitrate into the milk powder can, he was worried that Amao would die after eating it and dug up half of it. The court held that after searching for information such as the lethal dose of thallium nitrate for many times, knowing that thallium was still poisoned to death, Wang Xia should be considered as a crime of intentional homicide, which was an attempted crime.

The court sentenced Wang Xia to death for intentional homicide in the first instance. In the incidental civil action, the court supported compensation of more than 700,000 yuan.

Mr. Chen, an insider close to the trial of the case, said that Wang Xia had a strong willingness to get rid of the crime, repented in court and cried bitterly. Mr. Chen revealed that Wang Xia failed to seek the Lins’ understanding.

According to Huang Yue, the grandmother of the child, the Wangs never apologized after the incident, and the two families blamed each other.

However, Yang Zao admitted that Lin Jianxiong didn’t know about it. She said that the two brothers had a "good relationship", and the elder brother didn’t expect his wife to do such a thing.

The entanglement behind serial poisoning

At first instance, it was found that there was a conflict between family and sister-in-law.

As for the reasons for poisoning, the judgment of the first instance shows that according to the testimony of witnesses, Wang Xia and Lin Jianwei’s family have real estate interest conflicts and emotional contradictions. Wang Xia poisoned Lin Jianwei because he was dissatisfied with the store’s distribution to his brother-in-law and wanted to fight for more benefits; Poisoning Amao was because she was dissatisfied that Amao inherited the property right of the store after Lin Jianwei’s death, which had a conflict with her sister-in-law, Yang Zao.

In this regard, Lin Jianxiong explained that his parents verbally said that the old house and storefront were given to his younger brother, and the better house on the riverside was given to himself. Both suites were more than 100 square meters.

In Lin Jianxiong’s description, Wang Xia has a strong personality. He asked for a storefront before, but he didn’t buy it at home. According to Huang Yue’s testimony, she heard her sister say that Wang Xia said that the store should be half-owned.

Lin Jianxiong’s testimony shows that Wang Xia believes that her mother-in-law is partial to her sister-in-law. Yang Zao also admits that the relationship between the two sisters-in-law is not good, but they live separately and don’t meet much.

According to Yang Zao, in court, Wang Xia admitted that she was fighting for property, and also accused her mother-in-law and husband of being bad to her. Yang Zao commented that Huang Yue is a good mother-in-law.

Lin Jianxiong said frankly that he and Wang Xia were engaged to get a certificate in less than a month, and they didn’t have much emotional foundation, but they had three children and there would be "fetters". He is very busy in business, leaving early and returning late, and sometimes when he doesn’t come home, Wang Xia loses his temper and vents his dissatisfaction with him.

Yang Zao said that she and Lin Jianwei met on blind dates, but they had a good relationship. Yang Zao had never found that the delay in separation would produce such a big contradiction before. Recalling afterwards that her husband had told her "to go to Nanping", she regretted not leaving.

In the eyes of the villagers, Wang Xia is beautiful, tall and white, "elegant" and has few words.

"What is the state of Wang Xia’s heart, whether he is kind to the world, and whether he has close people, it is hard to say." Mr. Chen said that his evaluation of Wang Xia’s husband-wife relationship is not high.

Two years after the poisoning incident:

The girl is often hospitalized with limp limbs, and her mother runs away to make a living.

The judgment of the first instance shows that after identification, when the incident occurred nearly one year ago, Amathallium poisoning caused serious sequelae such as quadriplegia, which was identified as a serious injury and constituted a first-class disability.

The appraisal certificate issued nearly a year after the incident shows that Amao still has problems such as poor consciousness, backward development of large sports, unstable head-up, inability to turn over and poor control ability. The hospitalization certificate of Fuzhou Children’s Hospital in Fujian Province diagnosed him with severe pneumonia, sequelae of toxic encephalopathy, symptomatic epilepsy (secondary epilepsy) and so on.

When the reporter saw Amao, she had just left the hospital. At the age of 3, her limbs are limp and her fingers are stiff. When she sits up straight, her head hangs down and she doesn’t react much to the outside world. Huang Yue said that she "smiles when she is in a good mood". Nanny introduced that feeding can only break feeding, and it takes an hour to eat a meal.

Lin Jianxiong said that in fact, Amao’s organs, including lungs, have failed. She has no resistance and can’t go out. If she is not careful, she will catch a cold and have a fever, and she will be admitted to ICU for eight times out of ten hospitalizations.

The pain of one death and one serious injury in this family continues to this day. Recently, Amao was hospitalized with pneumonia and went to ICU again. Huang Yue said that after asking many hospitals, there was no good treatment. In the past two years, I have spent about 500,000 to 600,000 yuan on Amao, not counting the nanny fee.

The Lins are still waiting for the verdict of the second instance. Lin Jianxiong said that considering the issue of property distribution, he chose not to divorce Wang Xia first.

The Red Star journalist learned that Yang Zao returned to her family shortly after Amao was poisoned, and Amao was taken care of by the Lin family after that. Yang Zao said that since her husband died, she began to have conflicts with the Lin family, and she could not stay in the Lin family after the relationship broke down. She has to work to make a living now, and she can’t take Amao. She only visits the nanny occasionally every month, and she rarely meets the Lin family.

"It’s been two years, and I haven’t fully recovered." Yang Zao said that she loves her daughter very much. "I hope she will never suffer from illness."

Some opinions on relevant autonomy

    Universities and research institutes are engaged in exploratory and creative scientific research activities, which have unique advantages in knowledge and talents and are an important force in implementing the innovation-driven development strategy and building an innovative country. The CPC Central Committee and the State Council attached great importance to the decentralization of scientific research in universities and research institutes. In recent years, a series of reform measures have been introduced and achieved good results. However, with the deepening of scientific and technological innovation, it is increasingly difficult for universities and research institutes to adapt to the needs of practical development. In order to further improve the relevant institutional system, promote the expansion of autonomy in scientific research in universities and research institutes, comprehensively enhance innovation vitality, enhance innovation performance, increase the supply of scientific and technological achievements, and support high-quality economic and social development, we hereby put forward the following opinions.

    I. General requirements

    (1) Guiding ideology.

    Guided by Socialism with Chinese characteristics Thought of the Supreme Leader in the New Era, we will fully implement the spirit of the 19th National Congress of the Communist Party of China and the Second and Third Plenary Sessions of the 19th Central Committee, conscientiously implement the decision-making arrangements of the CPC Central Committee and the State Council, firmly establish a new development concept, follow the laws of scientific research activities, talent growth and achievement transformation, deepen the reform of the scientific and technological system, transform the government’s scientific and technological management functions, grasp the strategy, plan, policy and service, and support universities and research institutes to exercise scientific research-related autonomy according to laws and regulations. Fully mobilize the enthusiasm and creativity of units and personnel, enhance the vitality of innovation and the ability to serve economic and social development, and provide strong support for building an innovative country and a world science and technology power.

    (2) Basic principles.

    Adhere to the consistency between unit development and national mission. Adhere to and strengthen the party’s overall leadership over universities and research institutes, keep in mind the national mission, adhere to the national goal orientation, make full use of the responsibilities and powers entrusted by the state to organize work, actively undertake major scientific research tasks, integrate the development of units into the overall situation of national development, and realize their own sustainable development in the process of serving national goals.

    Adhere to the unified requirements and coordinate the classified policies. Expanding scientific research-related autonomy of universities and research institutes should conform to the overall requirements of the central classification to promote the reform of public institutions, respect scientific laws, accurately implement policies according to the different characteristics of universities and research institutes, implement classified management, and improve the pertinence and operability of policies.

    Adhere to the combination of decentralization and strengthening supervision. Minimize the government’s micro-management and direct intervention in the internal affairs of universities and research institutes, strengthen the overall grasp of the development direction, implement budget performance management, promote the construction of internal control mechanism, ensure full decentralization and effective undertaking, improve internal governance and strengthen external supervision, encourage action and serious accountability, and the power and responsibility are consistent.

    Second, improve the operation and management mechanism of institutions

    (3) Improve the management of articles of association. The competent department should, in accordance with the spirit of the central reform and the principle of separating government affairs from management, organize subordinate universities to improve their bylaws, promote scientific research institutes to formulate bylaws, and scientifically determine the functional orientation and rights and responsibilities of different types of units. Universities and research institutes should carry out scientific research activities in accordance with the functions and business scope stipulated in the articles of association, improve the internal governance structure and establish an efficient operation and management mechanism. The competent department shall not interfere in the affairs that the articles of association give management authority to universities and research institutes.

    (4) Strengthen performance management. Universities and research institutes should formulate medium-and long-term development goals and plans, and define performance goals and indicators. Competent departments should, in accordance with the principles of unity of power, responsibility, benefit and efficiency and classified evaluation, reduce process management, highlight innovation orientation, result orientation and performance orientation, implement medium-and long-term performance management and evaluation of universities and research institutes, and make the evaluation results public in an appropriate way, which will serve as an important basis for financial allocation of units, construction of scientific and technological innovation bases, evaluation and reward of leaders, and verification of total performance wages. The establishment department shall refer to the evaluation results when handling the adjustment of the establishment of scientific research institutions in accordance with the procedures.

    (5) Optimize the management of institutional setup. Science and technology departments should formulate plans for the reform, development and layout of scientific research institutions in accordance with the principles of clear functional orientation, reasonable layout, simplicity and high efficiency, and promote the optimal allocation of scientific and technological resources. Universities and research institutes can independently set up, change and cancel their internal institutions according to the national strategic needs, industry development needs and scientific and technological development trends, and according to the principle of simplification and efficiency.

    Third, optimize the scientific research management mechanism

    (6) Simplify the management process of scientific research projects. Improve the organization and implementation mechanism of major projects of the central financial science and technology plan, improve the project formation mechanism around the national demand, reasonably determine the project layout, quantity and volume, optimize the R&D team, strengthen the responsibility implementation and result assessment, and simplify the process management. Science and technology departments should work with relevant departments to streamline the project application process and reduce unnecessary application materials. "Milestone" management will be implemented during the project implementation to reduce all kinds of process evaluation, inspection, spot check and audit. Combine financial acceptance and technical acceptance, evaluate, standardize and dynamically adjust third-party audit institutions. Integrate the material submission links of various work and plans of science and technology management to realize multi-purpose of one form. The establishment of the national science and technology management information system according to the authority of the open system, where the information system has been provided or has been required to provide materials, shall not be required to provide repeated. Science and technology, finance, education departments and Chinese Academy of Sciences should carry out special actions to reduce the burden on scientific researchers and actively create an environment conducive to concentrated research.

    (seven) improve the management mechanism of scientific research funds. Reform the budgeting and payment method of indirect funds, instead of budgeting by the person in charge of the project, the project management department (unit) will directly approve and go through the formalities of fund payment, and the funds will be paid directly to the undertaking unit. Accelerate the pilot reform of scientific research management based on performance, integrity and ability, and timely summarize and promote the pilot experience and practices of scientific research project fund management. To implement the autonomy in the use of horizontal funds, the measures for the management of horizontal funds formulated by the unit according to the law can be used as the basis for audit and inspection. Allow the project undertaker to implement the contract system for food subsidies, local transportation fees and accommodation fees that are difficult to obtain invoices in domestic travel expenses. Science, technology and education departments timely select some universities and research institutes to explore the pilot reform of domestic travel reimbursement.

    (eight) improve the procurement management of scientific research instruments and equipment consumables. Simplify the procurement process, shorten the procurement cycle, and universities and research institutes can adopt more flexible and convenient procurement methods for instruments and equipment that are exclusively represented or produced according to relevant regulations and procedures. For the equipment and consumables urgently needed for scientific research, the procurement mechanism of special handling and on-call handling can be adopted, and the bidding procedure can be avoided. All units should establish a sound procurement management system for scientific research equipment and consumables, and make clear provisions on the procurement that really needs to be handled in a special way, so as to ensure that it is not chaotic.

    (9) Give innovative leading talents greater scientific research autonomy. The person in charge of the national scientific research project can independently adjust the research scheme and technical route according to the relevant provisions of the state, and independently organize the scientific research team. In the distribution of graduate enrollment plans of universities and research institutes with corresponding authorization, they should be inclined to the excellent teams and tutors who undertake major national scientific research projects such as major scientific and technological projects and key R&D plans. Explore strengthening the cultivation of doctoral students based on major scientific and technological innovation platforms, major scientific research projects and engineering projects, and improve the training cost sharing mechanism. Cadres in the leading bodies of universities and research institutes who are under the central management should strictly implement the relevant provisions of the central government, and the heads of internal R&D institutions can receive cash and equity rewards for the transformation of scientific and technological achievements according to laws and regulations, and implement the policies of differential treatment and classified management for teaching and research personnel who temporarily go abroad on business and take part-time jobs.

Universities and research institutes can independently formulate post setting plans and management methods in accordance with relevant state regulations and in combination with the development needs of scientific and technological innovation, and determine the proportion of post structure. The employment contract, post management and open recruitment system have been fully implemented, and the units that have established a flexible employment mechanism with the ability to go up and down can appropriately increase the proportion of senior professional and technical posts within the establishment, and the adjustment can be reported to the relevant departments for the record according to the management authority. Universities and research institutes are allowed to introduce outstanding talents to engage in innovative activities by setting up innovative posts and mobile posts. If the demand for high-level talents introduced by the unit is in urgent need, and it is difficult to meet the demand by adjusting the post setting, a certain number of special posts will be set up with the approval of relevant departments, which is not limited by the total number of posts, the highest level and the structural proportion, and the preparation matters will be reported to the organization establishment management department for special approval according to the procedures. After completing the relevant tasks, write them off according to the management authority.

    (13) Effectively delegate the authority to evaluate professional titles. Universities and research institutes independently formulate methods and operational plans for professional title evaluation according to state regulations, independently carry out professional title evaluation according to management authority, and report the evaluation results to the competent authorities for the record as required afterwards. The departments of human resources, social security and finance should, together with the relevant competent departments, explore the establishment of a wage system in line with the characteristics of the industry in some universities and research institutes.

Flexible distribution methods such as annual salary system, agreed salary and project salary can be implemented for team leaders who undertake key technical research tasks in key areas of the country and high-level talents urgently needed by the unit. The Ministry of Ecology and Environment announced typical cases of automatic monitoring, fraud and investigation of key pollutant discharge units

  According to the WeChat WeChat official account news of the Ministry of Ecology and Environment, since the beginning of this year, local ecological and environmental departments, together with the public security and procuratorial organs, have launched a special campaign to severely crack down on illegal crimes of hazardous waste and fraud of automatic monitoring data of key pollutant discharge units, and cracked down on tampering and forgery of automatic monitoring data. By October 2021, 270 cases of falsification of automatic monitoring data were investigated and dealt with nationwide, with a total fine of more than 49 million yuan, and the special action achieved remarkable results.

  In order to maintain the high-pressure situation of severely punishing the illegal and criminal acts of automatic monitoring data fraud, the Ministry of Ecology and Environment organized 12 key pollutant discharge units to investigate and deal with typical cases of automatic monitoring fraud. In the process of investigating these cases, eco-environmental departments at all levels actively use off-site supervision means such as big data analysis and video surveillance to strengthen the effective connection between off-site supervision and on-site inspection, and give full play to the function of judicial expertise in case handling, which is of exemplary significance for improving the efficiency of eco-environmental law enforcement and accurately cracking down on environmental crimes.

Typical cases announced this time include:

  1. Guangdong Shaoguan Haolan Environmental Protection Technology Co., Ltd. falsified and forged automatic monitoring data.

  On April 12th, 2021, the law enforcement officers of Shaoguan Ecological Environment Bureau made a surprise inspection of Shaoguan Haolan Environmental Protection Technology Co., Ltd., and found that the company changed the sampling method of automatic monitoring equipment such as chemical oxygen demand, ammonia nitrogen, total nitrogen and total phosphorus from "water sample tube sampling" to "standard sample tube sampling" without authorization, and put the diluted and prepared water samples of four kinds of wastewater pollutants in plastic bottles respectively, so that the automatic monitoring equipment collected water samples in plastic bottles through standard sample tubes for analysis and monitoring, which was suspected of tampering. Renhua County Environmental Monitoring Station sampled and monitored the company’s discharged wastewater on the same day, and the results showed that the ammonia nitrogen concentration was 63.3mg/L, which was 6.9 times higher than the discharge limit.

  After investigation, it was confirmed that Dai Mou, the person in charge of sewage treatment technology of the company, implemented the behavior of replacing the actual discharged wastewater with the diluted water sample and tampering with the automatic monitoring data. On September 22, 2021, Renhua County People’s Court sentenced Dai to six months’ imprisonment and fined RMB 7,000.

  Two, Hubei Xiangyang Bola Jingwei Fiber Co., Ltd. tampered with and forged automatic monitoring data.

  On June 1, 2021, Hubei Environmental Law Enforcement Supervision Bureau conducted surprise inspection on the suspected fraudulent points of automatic monitoring data according to the previous screening and tracking monitoring of abnormal data of automatic monitoring of pollution sources in the province. After on-site inspection, Xiangyang Bola Jingwei Fiber Co., Ltd. was suspected of using the embedded software of automatic monitoring equipment to forge and generate false monitoring data and upload it to the monitoring platform of the ecological environment department. On the same day, Xiangyang Ecological Environment Bureau seized the company’s automatic monitoring equipment for chemical oxygen demand and sent it to judicial authentication institutions for functional identification and data analysis. According to the judicial appraisal opinion issued by Hubei Software Evaluation Center, the embedded software in the inspection equipment has the function of artificial simulation to generate false automatic monitoring data, and there are 5523 pieces of automatic monitoring data stored in the sample, accounting for 90.4% of the total data, and there is forgery of automatic monitoring data. The monitoring results of the third-party monitoring unit on the wastewater from the main discharge port of the company’s sewage treatment station show that the concentration of chemical oxygen demand exceeds the discharge limit by 0.56 times.

  After investigation, it was confirmed that the person in charge of the company’s sewage treatment station, Kuang Mou, and the process supervisor, Huang Mou, illegally used the senior administrator account to log in to the embedded software system hidden in the automatic monitoring equipment for chemical oxygen demand. By setting relevant parameters, the equipment randomly generated the standard data and uploaded it to the monitoring platform, which led to the distortion of the automatic monitoring data for chemical oxygen demand in the company. Xiangyang City Bureau of Ecology and Environment ordered the company to correct its illegal behavior, fined it 500,000 yuan for its violation of the Regulations on the Administration of Pollutant Discharge Permit, and transferred the case to the public security organ according to law. At present, the procuratorate has arrested one person and the case is under further investigation.

  Three, Fujian Zhangzhou Fujian Kangzhiwei Food Industry Co., Ltd. tampered with and forged automatic monitoring data.

  On August 30, 2021, according to the clues reflected by the environmental protection grid staff in xiangcheng district, Zhangzhou City, Fujian Environmental Monitoring Corps organized personnel to consult the automatic monitoring data of sewage units in the grid area, and found that the data of chemical oxygen demand in the wastewater discharged by Fujian Kangzhiwei Food Industry Co., Ltd. remained stable at around 120 mg/L. On August 31st, the Provincial Environmental Monitoring Corps organized the Xiangcheng Ecological Environment Bureau of Zhangzhou City to carry out measurement and management linkage with the company, and found that the sampling line of the company’s chemical oxygen demand automatic monitoring equipment was inserted into a mineral water bottle filled with unknown liquid, and the data on the equipment showed 105.8 mg/L. After testing, the chemical oxygen demand concentration of unknown liquid in mineral water bottle is 132mg/L, and the actual chemical oxygen demand concentration of discharged wastewater is 1270mg/L, which is 1.54 times higher than the discharge limit.

  Zhangzhou Xiangcheng Ecological Environment Bureau ordered the company to correct the illegal behavior within a time limit, fined it 163,643 yuan for exceeding the standard discharge of pollutants, and transferred the case to the public security organ according to law. At present, the case has entered the stage of review and prosecution. At the same time, the local authorities initiated the consultation on compensation for ecological environment damage and copied it to the procuratorate. Under the supervision and guidance of the ecological environment department, the company adopted the repair method recognized by experts to proliferate and release the polluted river basin, and released more than 40,000 filter-feeding fish such as silver carp and bighead carp.

  Four, Wuhai city, Inner Mongolia Autonomous Region Rongxin Energy Industry Co., Ltd. tampered with and forged automatic monitoring data.

  On September 23, 2021, the Ministry of Ecology and Environment, the Department of Ecology and Environment of Inner Mongolia Autonomous Region and the Wuhai Municipal Bureau of Ecology and Environment jointly carried out special supervision and assistance for automatic monitoring, and found that the coking plant of Wuhai Rongxin Energy Industry Co., Ltd. was in production. The real-time data of automatic monitoring of coke oven discharge showed that sulfur dioxide was 0.20mg/m3, nitric oxide was 0.01mg/m3, and oxygen content was 14.30%, while the float flowmeter showed that the data was zero and no smoke passed through. On-site inspection by law enforcement officers found that the sampling pipeline of automatic flue gas monitoring equipment was not connected with the sampling probe, which made the automatic monitoring equipment unable to collect the discharged flue gas normally.

  After investigation, Wang, the person in charge of environmental protection of the company, disconnected the sampling pipeline of automatic monitoring equipment and tampered with the monitoring data in order to cover up the fact that sulfur dioxide in coke oven flue gas exceeded the standard. Hainan Branch of Wuhai Ecological Environment Bureau ordered the company to immediately correct the illegal act, fined 1 million yuan and transferred the case to the public security organ according to law. At present, the public security organs have accepted the case and carried out investigations.

  5. The case of tampering and forging automatic monitoring data by Shandong Yantai Suokun Glass Container Co., Ltd.

  Law enforcement officers of Yantai Ecological Environment Bureau found that the automatic monitoring data of Yantai Suokun Glass Container Co., Ltd. was abnormal when they read and analyzed the data of the automatic monitoring system of key pollution sources. On July 12, 2021, Yantai Environmental Law Enforcement Detachment, together with Yantai Public Security Bureau Food and Drug Environmental Investigation Detachment, made a surprise inspection of the company, and found a hidden PU pipeline near the sampling head of waste gas automatic monitoring equipment. Through tracing the source of the pipeline, it was found that there was a nitrogen generator and a gas transmission device. On the same day, the third-party monitoring unit sampled and monitored the exhaust gas discharged from the desulfurization tower of the company’s 1-2 melting furnace. The results showed that sulfur dioxide and particulate matter exceeded the emission limit by 262.34 times and 4.32 times respectively.

  After investigation, it was confirmed that Li, the general manager of the company, used nitrogen generator and other devices to blow nitrogen to the sampling head of automatic monitoring equipment to dilute the emission concentration of pollutants, which led to the distortion of monitoring data, and disconnected the gas supply pipeline during the on-site inspection by the ecological and environmental department in an attempt to cover up the illegal facts. Yantai City Bureau of Ecology and Environment ordered the company to immediately correct the illegal behavior, fined 775,000 yuan for its excessive discharge of pollutants, and transferred the case to the public security organ according to law. At present, the public security organs have accepted the case and carried out investigations.

  Six, Hebei Hengshui Fucheng County Development Zone Construction Investment Co., Ltd. Sewage Treatment Branch tampered with and forged automatic monitoring data.

  During the online inspection of the automatic monitoring data of enterprises, Hengshui Eco-environment Comprehensive Law Enforcement Detachment found that the historical data of automatic monitoring of wastewater discharged from the sewage treatment branch of Fucheng Development Zone Construction Investment Co., Ltd. was obviously abnormal, and the concentrations of pollutants such as ammonia nitrogen and total nitrogen often suddenly dropped sharply before rising to the critical point of exceeding the standard. Therefore, on May 26, 2021, it conducted a surprise inspection with the Huanan Detachment of Hengshui Public Security Bureau. In order to find out the reasons for the sudden change of automatic monitoring data, the public security organs conducted an investigation and inquiry on the relevant person in charge and some employees of the company. Relevant evidence shows that employees such as Chang and others will regularly report data fraud to the factory director Hu.

  After investigation, the company arranged a special person to be responsible for the operation of automatic monitoring facilities. When the monitoring data tends to exceed the standard, the staff on duty will pull out the sampling tube of automatic monitoring equipment and insert it into the pre-prepared water sample that meets the standard, so as to achieve the goal of automatic monitoring data reaching the standard. Fucheng County Branch of Hengshui City Ecological Environment Bureau transferred the case to the public security organ according to law, and nine responsible persons have been criminally detained. At present, the case has been transferred to the procuratorate for review.

  7. Zhejiang Huzhou Changxing Xintiandi Environmental Protection Technology Co., Ltd. falsified and forged automatic monitoring data.

  On May 12, 2021, according to the clues provided by the public security organs’ model warning, Huzhou Comprehensive Administrative Law Enforcement Team of Ecological Environment Protection, Huzhou Ecological Environment Director Xing Branch and the public security organs jointly conducted a night surprise inspection on Changxing Xintiandi Environmental Protection Technology Co., Ltd., and found that the company added a diluent of "chemical oxygen demand remover" into the discharged wastewater through plastic pipes. After testing, the main component of the remover is sodium chlorate, which will interfere with the determination process of chemical oxygen demand and make the determination result low.

  After investigation, in order to reduce the automatic monitoring value of chemical oxygen demand, Xia Mou, the director of the company, added the "chemical oxygen demand remover" to the discharged wastewater many times by himself or by instructing employees, which led to the distortion of the automatic monitoring data of chemical oxygen demand of the company. Xing Branch, director of Huzhou Ecological Environment Bureau, transferred the case to the public security organs according to law. At present, criminal compulsory measures have been taken against four suspects, and the case is under further investigation.

  Eight, Zhejiang Wenzhou Bicheng Printing and Dyeing Co., Ltd. tampered with and forged automatic monitoring data.

  In May, 2021, law enforcement officers of Pingyang Branch of Wenzhou Eco-environment Bureau found that the automatic monitoring data (minute value) of ammonia nitrogen in wastewater discharged by Wenzhou Bicheng Printing and Dyeing Co., Ltd. showed abnormal zero value many times, but the chemical oxygen demand and instantaneous flow showed normal. Through video surveillance, it is found that every time the ammonia nitrogen data is abnormal, people enter the automatic monitoring station room and restart the switching power supply of the ammonia nitrogen automatic monitoring equipment, resulting in zero data. On June 2, a joint task force composed of Wenzhou City and Pingyang County’s two levels of ecological environment and public security law enforcement backbone conducted a surprise inspection of the company.

  After investigation, it was confirmed that Qiu Mou and Wu Mou, sewage treatment operators of the company, were punished by the company in order to avoid the effluent exceeding the standard. When the ammonia nitrogen data of the automatic monitoring equipment exceeded the standard, they entered the station building illegally for many times, and restarted the automatic monitoring equipment through the switching power supply, so that the data became zero, so as to achieve the purpose of false monitoring data reaching the standard. The Wenzhou Municipal Bureau of Ecology and Environment ordered the company to immediately correct the illegal act and transfer the case to the public security organ according to law. At present, the case has been transferred to the procuratorate for review and prosecution, and two suspects have been released on bail pending trial.

  Nine, Anhui Bozhou Zhenxi New Building Materials Co., Ltd. tampered with and forged automatic monitoring data.

  On September 14th, 2021, the law enforcement officers of Anhui Ecological Environmental Protection Comprehensive Administrative Law Enforcement Bureau found through the "Digital Jianghuai-Smart Environmental Protection" big data platform and video surveillance video that the automatic monitoring data of sulfur dioxide of Zhenxi New Building Materials Co., Ltd. in Kanzhen Town, Lixin County, Bozhou City suddenly dropped in a short time after exceeding the standard for many times, and at the same time, some suspected enterprise personnel entered the automatic monitoring station to operate the automatic monitoring equipment. From September 15th to 20th, the Provincial Comprehensive Administrative Law Enforcement Bureau of Ecological Environmental Protection and the Lixin County Brigade of Bozhou Comprehensive Administrative Law Enforcement Detachment of Ecological Environmental Protection conducted an on-site inspection of the company.

  According to the investigation, from August 26th to September 14th, 2021, Xu, an employee of the company, entered the automatic monitoring station several times after finding that sulfur dioxide exceeded the standard, and illegally replaced the original filter element with the filter element washed with alkali liquor, resulting in a significant reduction in the automatic monitoring value of sulfur dioxide, which was "disguised" in the way of "falsely reaching the standard". The ecological environment branch of Lixin County, Bozhou City transferred the case to the public security organ according to law. At present, Xu has been under criminal detention and the case is under further investigation.

  X. The case of tampering and forging automatic monitoring data by Sichuan Panzhihua Titanium Chemical Co., Ltd.

  On June 22, 2021, Sichuan Ecological Environmental Protection Comprehensive Administrative Law Enforcement Corps found that the automatic monitoring data of Panzhihua Titanium Chemical Co., Ltd. was abnormal by analyzing the monitoring data, and immediately cooperated with Panzhihua Ecological Environmental Protection Comprehensive Administrative Law Enforcement Detachment to carry out a surprise inspection of the company. On-site inspection found that the sulfur dioxide concentration displayed by the flue gas analyzer of the automatic tail gas monitoring equipment of the rotary kiln of the company was 3292.9mg/m3, which was 2.87 times higher than the limit specified in the Emission Standard of Air Pollutants for Industrial Kilns (GB 9078-1996). At the same time, the sulfur dioxide concentration displayed by the industrial computer of the equipment was only 197.57mg/m3. The inspectors used sulfur dioxide standard gas to check the automatic monitoring equipment, and found that the readings of industrial computer and data acquisition instrument were 94% smaller than those of analyzer.

  Focus on advanced nuclear energy, smart grid, new energy storage, natural gas and other advantageous fields, give full play to the traction role of leading enterprises in Futian, Longgang, Dapeng and other regions, vigorously cultivate "specialized and innovative" small and medium-sized enterprises, and promote the coordinated and high-quality development of the whole industrial chain. Focusing on renewable energy fields such as photovoltaic and offshore wind power, we will explore market applications to promote the development of industrial clusters, focus on expanding and strengthening new energy equipment manufacturing and producer services in Shenzhen-Shantou Special Cooperation Zone, encourage enterprises to actively explore domestic and foreign markets, and build a number of leading brands with international influence.
