Notice of the General Office of Yunnan Provincial People’s Government on Standardizing the Operation and Management of Investment Approval Intermediary Supermarket in Yunnan Province
The people’s governments of prefectures, cities, counties and districts, provincial committees, offices, departments and bureaus, and relevant enterprises and institutions:
According to the Notice of the General Office of the People’s Government of Yunnan Province on Printing and Distributing the Implementation Plan for the Construction of the Investment Approval Intermediary Supermarket in Yunnan Province and the Interim Measures for the Management of the Investment Approval Intermediary Supermarket in Yunnan Province (Yun Zheng Ban Han [2015] No.130), the investment approval intermediary supermarkets at all levels in the province (hereinafter referred to as the intermediary supermarkets) will soon be completed and put into operation. In order to standardize the operation and management of intermediary supermarkets in the province, and create a fair, open, fair and transparent, orderly competition, standardized practice, convenient for enterprises and the people, clean and efficient intermediary service market environment, with the consent of the provincial people’s government, relevant matters are hereby notified as follows:
First, get ready for operation
(a) to create operating conditions. Intermediary supermarket is a unified platform for public selection of investment approval intermediary services (hereinafter referred to as intermediary services), and it is an important content of building a government ruled by law, an innovative government, a clean government and a service-oriented government. Governments at all levels should conscientiously implement the decision-making arrangements of the provincial people’s government, organize the completion of system deployment, platform construction, project organization, staffing and business training as soon as possible, and ensure that intermediary supermarkets meet the operating conditions on time.
(two) clear management functions. Governments at all levels should make it clear that government service management institutions are the operation management departments of intermediary supermarkets at the same level, give management services and supervision and evaluation responsibilities, and provide necessary guarantees in terms of personnel and funds to ensure the normal operation of intermediary supermarkets.
(3) Seriously organize to settle in. Development, reform and organization departments at all levels should carefully sort out the list of items for examination and approval of government investment projects at the corresponding level and the corresponding list of items for investment examination and approval intermediary services, and dynamically manage the item information through the online examination and approval supervision platform of investment projects in the province and the online intermediary information management system. Relevant administrative and industry authorities should promptly organize the information review, filing and entry of intermediary service agencies in strict accordance with the qualification types and work processes of intermediary service agencies stationed in the province’s intermediary supermarkets, so as to truly realize the full liberalization and equal competition of the investment approval intermediary service market, break the geographical barriers and industry monopoly protection, and further stimulate market vitality.
Second, standardize the operation and management
(4) Define the scope of selection. The provincial administrative organs, enterprises and institutions (hereinafter referred to as procurement units) shall, in accordance with the principle of "territorial management, graded procurement, competitive selection and one-thing selection", organize the use of fiscal and state-owned funds to purchase projects with investment approval intermediary services of less than 1 million yuan (except confidential projects) in the intermediary supermarkets at the corresponding level, and openly select intermediary services, and shall not designate intermediary services in any form; For projects of 1 million yuan or more, the agency will determine the intermediary service agency by means of public bidding when entering the public resource trading centers at all levels, and the signed contract will be registered in the intermediary supermarket at the same level, and the project code will be associated with the investment approval and supervision platform, which will be included in the supervision and management of the whole life cycle of the investment project.
(5) Strict project management. Investment examination and approval departments at all levels shall not entrust their subordinate (competent) intermediary service institutions to carry out intermediary services related to investment examination and approval of their own departments. The investment examination and approval department shall give priority to the service items provided by various intermediary service agencies selected by intermediary supermarkets, and the financial department shall allocate relevant expenses on time. For the service items that the procurement unit has entrusted the intermediary service agencies to complete, the intermediary supermarkets at all levels should strictly review and check, and may not select the same agency to carry out the technical review of the matter.
(6) Strengthen industry supervision. Intermediary service agencies that have settled in the province’s intermediary information management system can carry out relevant work in intermediary supermarkets at all levels, consciously abide by national laws and regulations and the regulations on the operation and management of intermediary supermarkets, and carry out intermediary services within the scope of qualification according to laws and regulations. At the same time, it is necessary to strictly enforce industry self-discipline, establish systems such as service commitment, time-limited completion, practice publicity and one-time notification, optimize service processes, standardize practice behavior, and improve service quality and efficiency. Industry authorities at all levels should conscientiously perform their duties of industry supervision, establish and improve the complaint reporting mechanism, and strengthen the supervision and management of intermediary service institutions.
(7) Strengthening system construction. Intermediary supermarket management departments at all levels should conscientiously implement the requirements of the national and provincial people’s governments to clean up and standardize the intermediary services for administrative examination and approval, and formulate strict operating rules, supervision and management systems to ensure the fair, just, open, standardized and efficient operation of intermediary supermarkets. The implementation of intermediary service star rating and intermediary service institutions credit file records, credit rating evaluation system, the relevant business information of intermediary service institutions to the public, and the credit record information into the national unified credit information platform. Establish a disciplinary and elimination mechanism, publicly expose and blacklist intermediary service agencies that issue false certificates or reports and other violations, and clear out intermediary supermarkets in Yunnan Province.
Third, the overall organization and implementation
(eight) unified thinking and understanding. The operation and management of intermediary supermarkets is an important measure to comprehensively deepen the reform of administrative examination and approval system, innovate government procurement methods and create a level playing field. All localities and departments should fully understand the importance and urgency of the operation and management of intermediary supermarkets, strengthen organizational leadership, change ideas and concepts, and actively participate in the open selection of intermediary services. Further intensify publicity, create a good public opinion atmosphere, and promote the healthy and orderly development of intermediary supermarkets.
(9) Carefully organize the operation. Governments at all levels should organize intermediary supermarkets at the same level to start operation as soon as possible, and conscientiously do a good job in reviewing and issuing procurement announcements, openly selecting intermediary service agencies, tracking contract negotiations and recording credit information according to the needs of intermediary service projects of procurement units. Where the use of financial and state-owned funds to buy intermediary service projects, provincial and state-level procurement units must be in March 31, 2016, county-level procurement units must be in July 31, 2016, all entered the intermediary supermarket at the same level for public selection.
(10) Strict work discipline. Governments at all levels should organize government supervision, supervision, finance and auditing departments to carry out special supervision and inspection on the operation and management of intermediary supermarkets in a timely manner. For those units and individuals who do not enter the intermediary supermarket in accordance with the regulations, openly select intermediary service agencies, illegally accept and approve intermediary service matters, illegally use fiscal and state-owned funds to pay intermediary service fees, and violate the principle of fairness and openness, deliberately obstruct or restrict the intermediary agencies that meet the requirements of entering the intermediary supermarket, supervisory organs at all levels should investigate their responsibilities in accordance with relevant regulations.
